Privacy Policy
Effective October 19, 2026. 5PM Barometer is operated by 5PM NYC, a sole proprietorship based in New York City ("5PM NYC", "we", "us"). Our mailing address is 1178 Broadway, 3rd Floor #1414, New York, NY 10001. Questions go to data@5pm.nyc.
1. The short version
- We collect what we need to run your account and bill you: your name, email address, the establishment you represent, and your plan.
- The prices, menus and happy hour details you enter are added to the shared dataset on the same footing as the prices on your published menu, unless you turn contributing off. You can turn it off by emailing us.
- We do not sell personal information, we do not share it for advertising, and we do not use advertising cookies. We use Google Analytics to count visits, as described in section 6.
- You can export or delete your account data by emailing us. We answer within 30 days.
2. What we collect
Information you give us
- Account details. Your name, your email address, and the establishment you tell us you represent. When you sign up, you confirm that you are authorized to act for that establishment and that your account will be tied to it.
- Prices and menus. Drink prices you add or edit, menu photos or PDFs you upload and the lines we read from them, your happy hour days, times and prices, and any notes you attach.
- Lists and listings. Establishments you star as competitors, and establishments you add because they were not in our directory (a name and a street address).
- Correspondence. Emails you send us, including corrections and support requests.
- Google sign-in. If you choose to sign in with Google, Google sends us your name, your email address and your profile picture. We store the name and the email address and nothing else, and we never read from or write to your Google account.
Information we receive from others
- Billing. Payments are handled by Stripe. Stripe tells us your plan, the status of your subscription, the payment dates and amounts, and, for support, the card brand and last four digits. We never see or store full card numbers.
- Public information about your establishment. The comparison data in 5PM Barometer combines proprietary data held by 5PM NYC with publicly available information. Every price is drawn directly from a published menu or an owner submission and is tied to the establishment and the month in which it was recorded. This is information about businesses, not about people.
Information collected automatically
- Server logs. Our hosting provider records the IP address, browser type, requested page and time of each request, which we use to keep the service running, to enforce daily usage limits and to investigate abuse. Logs are kept for 90 days.
- Arrival channel. If you reach us from a postcard, an email or the newsletter, the link tells us which one, and we keep that with your account so we know which channels work. Nothing else about your browsing is tracked.
We do not collect precise location, biometric information, government identifiers, or information about anyone under 18. The service is for business use by adults.
3. How we use it
- To run your account: sign-in links, your reports, your saved prices and settings on any device you sign in from.
- To bill you, send receipts, renewal reminders, payment failure notices and the acknowledgment of your subscription terms.
- To read menus you upload. Menu images are sent to an automated reading service (see section 5) and the drink lines it returns are shown to you for review before anything is saved.
- To build the comparisons and the public reports, using contributed data as described in section 4.
- To answer your emails and to fix problems.
- To send you occasional email about 5PM Barometer, such as a new report edition. Every such email has an unsubscribe link, and opting out never affects service emails about your account or billing.
- To protect the service: enforcing usage limits, detecting bulk extraction or shared sign-ins, and complying with the law.
4. Your prices, menus and contributions
Shared by default. Prices you enter, prices we read from menus you upload, and happy hour details you add are contributed to the shared dataset. Contributing is on when you open your account. You can turn it off before your first save by emailing us.
What contributing means. Contributed prices are treated exactly like the prices on your published menu: they appear to other members as your establishment's listed prices, they are included in neighborhood, borough and citywide figures, and they may appear in aggregate in our public reports. Aggregate figures never single out an establishment; establishment-level figures are the same listed prices anyone can read on your menu.
Turning it off. Email data@5pm.nyc and contributing stops. Prices you enter afterward stay private to your account: they power your own comparisons and are not shown to other members or included in the dataset or the public reports. Prices contributed before you turned it off remain in the monthly snapshots and reports they were already part of; the next monthly refresh uses your published menu only.
Establishments you add. If you add an establishment that is not in our directory, its name and address become part of our directory so that you and other members can select it. That is business listing information, not personal information.
5. Who we share information with
We share information only with the providers that help us run the service, each under terms that limit them to providing that service to us. We do not sell personal information and we do not share it with anyone for advertising.
| Provider | What it does for us | What it receives |
|---|---|---|
| Stripe | Payments and subscriptions | Your name, email address, card details you enter on Stripe's page, and your plan |
| Supabase | Accounts, sign-in and database | Your account details, your saved prices and settings |
| Resend | Sends our email | Your email address and the content of the emails we send you |
| Netlify | Hosting and server logs | Request logs described in section 2 |
| Anthropic | Reads uploaded menus | The menu images or PDF pages you upload, sent through its business API, which under its terms does not use them to train its models. Images are not kept by us after they are read. |
| OpenStreetMap Nominatim | Turns a street address into map coordinates | The address you type when adding an establishment |
| Esri | Map tiles | Standard requests for map images, including your IP address |
| Google Analytics | Visit statistics | Pages visited, referring site, device and browser type, approximate location and a cookie identifier |
| Google Fonts, cdnjs, jsDelivr | Fonts and script libraries | Standard requests, including your IP address |
We may also disclose information when the law requires it, to protect our rights or the safety of others, or as part of a sale or merger of the business, in which case this policy continues to apply to the information transferred.
6. Cookies and browser storage
We use your browser's local storage to keep you signed in and to remember your settings, such as your theme, text size and the establishment you selected. We use Google Analytics to understand how the site is used: which pages are visited, how visitors arrived, the device and browser type, and approximate location. Google Analytics sets its own cookies for this. We never send your name, email address or menu data to Google Analytics, and we do not use advertising cookies or tracking pixels. You can opt out with Google's opt-out browser add-on. Because we do not track you across sites, we do not respond differently to "Do Not Track" or Global Privacy Control signals; there is nothing to turn off.
7. Keeping and deleting information
- Account data is kept while your account is open and for 12 months after it closes, in case you come back, then deleted.
- Contributed prices are kept as part of the shared dataset and its monthly snapshots, as described in section 4, including after your account closes.
- Uploaded menu images are not stored. They are read once and discarded; only the drink lines you approve are saved.
- Billing records are kept for seven years as tax and accounting rules require.
- Server logs are kept for 90 days.
Email data@5pm.nyc from your account address to see, correct, export or delete your information. We will confirm your identity and respond within 30 days. Deleting your account removes your private prices and settings; it does not remove contributed prices from datasets or reports already published.
8. Security
We keep a written data security program with administrative, technical and physical safeguards appropriate to the size of our business and the information we hold, as New York's SHIELD Act requires. In practice that means sign-in by emailed link with no passwords to leak, encryption in transit and at rest with our providers, access to member data limited to the people who run the service, row-level security on the database, daily usage limits, and provider contracts that require the same care. No system is perfectly secure. If a breach affects your private information, we will notify you without unreasonable delay and within 30 days of discovering it, as New York law requires, and we will tell you what happened and what we are doing about it. Tell us right away at data@5pm.nyc if you think someone else has used your account.
9. Your choices and rights
- Email. Unsubscribe from marketing email with the link in any message. Service emails about your account and billing continue while your account is open.
- Contributions. Turn contributing off or back on at any time, as described in section 4.
- Access, correction, export and deletion. Email us, as described in section 7.
- No discrimination. We will never charge you more or serve you less because you exercised a privacy right.
California residents. 5PM Barometer is built for New York City establishments and we do not expect to meet the thresholds of the California Consumer Privacy Act. Even so, we honor the rights it describes for anyone who asks: to know what we hold, to delete it, to correct it, and to opt out of sale or sharing. We do not sell or share personal information as those terms are defined in that law.
Other states. If you live in a state with its own privacy law, you can make the same requests and we will honor them in the same way.
10. Children
5PM Barometer is for people aged 18 or older acting for a business. We do not knowingly collect information from anyone under 18. If you believe a minor has given us information, email us and we will delete it.
11. Changes to this policy
If we change this policy in a way that affects you, we will email account holders at least 14 days before the change takes effect and post the new effective date here. Continuing to use the service after that date means you accept the updated policy.
